Introduction

You will find our General Terms and Conditions below. These apply each time you use or place an order via our Website and contain important information for you as a buyer. Therefore, please read the General Terms and Conditions carefully. We also recommend to save these terms and conditions or to print them so that you can read them again at a later stage.

Definitions

Animal Politics Foundation: established in Amsterdam and listed with the Chamber of Commerce under registration number 56789076, acting under the name of Animal Politics Foundation.

Website: the website of the Animal Politics Foundation, to be consulted via https://www.partyfortheanimals.nl/our-books/ and all accompanying subdomains.

Customer: Customer who, whether or not acting in the course of a profession or business, enters into an Agreement with the Animal Politics Foundation and/or who has registered on the Website.

Agreement: each arrangement or agreement between the Animal Politics Foundation and Customer. The General Terms and Conditions form an integral part of the agreement.

General Terms and Conditions: the current General Terms and Conditions.

Article 1. Applicability of General Terms and Conditions

1.1. The General Terms and Conditions apply to all offers, Agreements and deliveries of the Animal Politics Foundation, unless explicitly otherwise agreed in writing.

1.2. If Customer includes provisions or conditions in his order, confirmation or notice, constituting acceptance, that deviate from, or are not incorporated in the General Terms and Conditions, they will only be binding on the Animal Politics Foundation if and to the extent that they have been explicitly accepted by the Animal Politics Foundation.

1.3. In the event that special product or service conditions apply, in addition to these General Terms and Conditions, those conditions will also apply, but in the event of conflicting conditions Customer may, at any time, invoke the applicable provision that is the most favourable to him.

Article 2. Prices and Information

2.1. All prices stated on the Website and in other materials originating from the Animal Politics Foundation are inclusive of BTW (VAT) and, unless otherwise stated on the Website, other levies imposed by the government.

2.2. There are no separate shipping costs.

2.3. The content of the Website has been compiled with the greatest care. However, the Animal Politics Foundation cannot guarantee that all information on the Website is always correct and complete. All prices and other information on the Website and in other materials originating from the Animal Politics Foundation are, therefore, subject to apparent programming or typing errors.

2.4. The Animal Politics Foundation cannot be held responsible for (colour) variations due to monitor quality.

Article 3. Formation of Agreement

3.1. The Agreement is concluded when Customer accepts the offer of the Animal Politics Foundation and complies with the related conditions set by the Animal Politics Foundation.

3.2. If Customer has accepted the offer via electronic means, the Animal Politics Foundation will promptly confirm the receipt of the acceptance of the offer via electronic means. As long as the receipt of this acceptance has not been confirmed, Customer will have the option to dissolve the Agreement.

3.3. If it appears that Customer has provided incorrect information on acceptance of the Agreement or conclusion in another way, the Animal Politics Foundation will be entitled to only meet its obligation after it has received the correct information.

3.4. The Animal Politics Foundation may find out within the statutory parameters if Customer is able to meet his payment obligations, but also enquire after all facts and factors that are important for a responsible conclusion of the Agreement. If that enquiry gives the Animal Politics Foundation proper grounds for declining to conclude the Agreement, it will have the right, supported by reasons, to reject an order or application or to bind its implementation to special conditions, such as advance payment.

Article 4. Registration

4.1. To make optimal use of the Website, Customer can register himself via the registration form / the option to create an account on the Website.

4.2. During the registration procedure, Customer chooses a user name and password with which he can log in on the Website after registration. Customer is personally responsible for choosing a sufficiently reliable password.

4.3. Customer must keep his login data, his user name and password strictly confidential. The Animal Politics Foundation assumes no liability for misuse of the login data and may always assume that a Customer who registers on the Website is in fact that Customer. Everything that happens via the account of Customer is the responsibility and risk of Customer.

4.4. If User knows or suspects that his login data has got in the hands of unauthorised persons, he must change his password and/or notify the Animal Politics Foundation thereof as soon as possible so that the Animal Politics Foundation can take adequate measures.

Article 5. Execution of Agreement

5.1. As soon as the order has been received by the Animal Politics Foundation, the Animal Politics Foundation will send the products as soon as possible subject to the provisions of paragraph 3 of this Article.

5.2. The Animal Politics Foundation is entitled to engage third parties for the fulfilment of its obligations arising from the Agreement.

5.3. The Website clearly describes, in good time before concluding the Agreement, in what way delivery will take place and within which period the products will be delivered. If no delivery period has been agreed or is stated, the products will in any case be delivered within 30 days.

5.4. If it is unable to deliver the products within the agreed period, the Animal Politics Foundation will notify Customer thereof. Customer may in such case agree to a new delivery date or he will be given the chance to dissolve the Agreement at no cost.

5.5. The Animal Politics Foundation recommends Customer to check the delivered products and to report, preferably in writing, any defects that have become evident during this check, within a reasonable period. See for more detail the Article concerning guarantee and conformity.

5.6. As soon as the products to be delivered are delivered at the delivery address given, the risk concerning these products will pass to Customer. If explicitly otherwise agreed, the risk will pass to Customer sooner. If Customer decides to collect the products, the risk will pass on transfer of the products.

5.7. The Animal Politics Foundation is entitled to deliver a product equal to the ordered product and of the same quality, if the ordered product is no longer available. Customer will then be entitled to dissolve the Agreement at no cost and to return the product free of charge.

Article 6. Right of Withdrawal

6.1. This Article applies only to Customer if he is a natural person, who does not act in the course of his profession or business.

6.2. Customer has the right to dissolve a distance agreement with the Animal Politics Foundation at no cost within 14 days of receipt of the product, without stating reasons.

6.3. The period commences on the day after Customer, or a third party previously designated by him, who is not the carrier, received the product, or:

  • if Customer has ordered several products in the same order: the day on which Customer, or a third party previously designated by him, received the last product;
  • if the delivery of a product consists of several shipments or parts: the day on which Customer, or a third party previously designated by him, received the last shipment or the last part;
  • in the event of Agreements for the frequent delivery of products during a specific period: the day on which Customer, or a third party previously designated by him, received the first product.

6.4. Only direct costs for the return shipment will be charged to Customer. Customer must therefore bear the return costs himself. If these costs are higher than the regular postal rate, the Animal Politics Foundation will provide a cost estimate. Any costs paid by Customer for shipment and payment of the product to Customer will be returned to Customer on return of the full order.

6.5. Customer will handle the product and packaging carefully within the withdrawal term referred to in paragraph 1. Customer will open the packaging and use the product only to the extent that this is necessary for inspecting the nature, features and operation of the products. The basic principle is that this inspection will not go beyond what Customer would be able to do in a physical shop.

6.6. Customer will only be liable for depreciation of the product if this is the result of the way in which the product is handled, which goes beyond what is permitted in the previous paragraph.

6.7. Customer may dissolve the Agreement in accordance with the period provided in paragraph 1 of this Article by forwarding the standard form for withdrawal (digitally) to the Animal Politics Foundation, or by notifying the Animal Politics Foundation in another unambiguous way saying that he has decided not to go ahead with the purchase. In case of a digital notice, the Animal Politics Foundation will confirm receipt of this notice. Following dissolution, Customer will have another 14 days to return the product. It is also possible to immediately return the product within the time for reflection referred to in paragraph 1 of this Article, on the condition that the standard form for withdrawal or other unambiguous statement for withdrawal is attached.

6.8. Payments already made by Customer (in advance) will be returned to Customer as soon as possible, but no later than within 14 days after dissolution of the Agreement, in the same way as Customer has paid the order. If Customer has chosen a more expensive method of delivery than the cheapest standard delivery, the Animal Politics Foundation will not have to return the additional costs for the more expensive method. Unless the Animal Politics Foundation offers to collect the product itself, the Animal Politics Foundation may wait to return payment until the Animal Politics Foundation has received the product or until Customer gives evidence of returning the product, whichever is earliest.

6.9. The Website clearly states, in good time before concluding the Agreement, whether the right of withdrawal applies or not, and the required procedure, if any.

Article 7. Payment

7.1. Customer must make payments to the Animal Politics Foundation according to the methods of payment indicated in the order procedure and possibly on the Website. The Animal Politics Foundation is free to choose the methods of payment offered and these may change from time to time. In the event of payment after delivery, Customer will have a payment term of 14 days starting on the day after delivery.

Article 8. Guarantee and Conformity

8.1. This Article applies only if Customer is a person, who does not act in the course of his profession or business. If the Animal Politics Foundation issues a separate guarantee on the products, this guarantee will apply to all types of Customers, without prejudice to the above provision.

8.2. The Animal Politics Foundation guarantees that the products meet the Agreement, the specifications stated in the offer, the reasonable requirement of reliability and/or usability, and the statutory provisions and/or existing government regulations at the time the Agreement is concluded. If specifically agreed, the Animal Politics Foundation also guarantees that the product is suitable for other than normal use.

8.3. If the delivered product does not conform to the Agreement, Customer must notify the Animal Politics Foundation thereof within a reasonable period after he has discovered the defect.

8.4. If the Animal Politics Foundation considers the complaint well-founded, the relevant products will be repaired, replaced or reimbursed following consultation with Customer. The maximum reimbursement subject to the Article regarding liability is equal to the price paid for the product by Customer.

Article 9. Guarantee on Business Purchases

9.1. The Animal Politics Foundation guarantees that the products meet the Agreement, the specifications stated in the offer, the reasonable requirement of reliability and/or usability, and the statutory provisions and/or existing government regulations at the time the Agreement is concluded. If specifically agreed, the Animal Politics Foundation also guarantees that the product is suitable for other than normal use. Otherwise the product is suitable for normal use.

9.2. If the delivered product does not conform to the Agreement on delivery, Customer must notify the Animal Politics Foundation thereof within a reasonable period after he has discovered the defect.

9.3. If the Animal Politics Foundation considers the complaint well-founded, the relevant products will be repaired, replaced or (partially) reimbursed.

Article 10. Complaints Procedure

10.1. If Customer has a complaint concerning a product (in accordance with the Article regarding guarantee and conformity) en/or concerning other aspects of the service provision by the Animal Politics Foundation, he may file a complaint with the Animal Politics Foundation by telephone, by e-mail or by mail. See the contact details under the General Terms and Conditions.

10.2. The Animal Politics Foundation will respond to Customer about his complaint as soon as possible, but at least within 7 days after receipt of the complaint. If it is not yet possible to give a substantive or final response, the Animal Politics Foundation will confirm receipt of the complaint within 7 days of receipt of the complaint, and give an indication of the period within which it expects to give a substantive or final response to the complaint of Customer.

10.3. Any Customer who does not act in the course of his profession or business may also file a complaint via the European dispute resolution procedure, to be reached via https://webgate.ec.europa.eu/odr/.

Article 11. Liability

11.1. This Article applies only if Customer is a natural person or legal person, who acts in the course of his profession or business.

11.2 The Animal Politics Foundation’s total liability towards Customer due to an attributable failure to perform this Agreement will be limited to compensation of the sum stipulated for this Agreement (inclusive of BTW (VAT)).

11.3. The Animal Politics Foundation’s liability towards Customer for indirect damage, including in any case – but explicitly not excluding – consequential loss or profit, lost profit, lost savings, loss of data and loss due to business interruption, is excluded.

11.4. Apart from the cases referred to in the previous two paragraphs of this Article, the Animal Politics Foundation cannot be held liable by Customer for damages, irrespective of the ground on which the action for damages would be based. However, the limitations referred to in this Article will lapse if and to the extent that damage is the result of wilful misconduct or gross negligence on the part of the Animal Politics Foundation.

11.5. The Animal Politics Foundation’s liability towards Customer due to an attributable failure to perform this Agreement arises only if Customer immediately and properly serves a notice of default on the Animal Politics Foundation allowing the latter a reasonable period to remedy any failure in the performance, and if the Animal Politics Foundation continues to fail in the performance of its obligations after this period. The notice of default must contain an as detailed a description of the failure as possible so that the Animal Politics Foundation is able to respond adequately.

11.6. A claim for compensation cannot be considered unless Customer has given written notice of the loss or damage to the Animal Politics Foundation as soon as possible, yet no later than within 30 days after it has arisen.

11.7. In the event of force majeure, the Animal Politics Foundation will not be obliged to compensate any damage arisen with Customer as a result.

Article 12. Retention of Title regarding Business Purchases

12.1. As long as Business Customer has not made full payment for the entire agreed sum, all products delivered will remain the property of the Animal Politics Foundation.

Article 13. Personal details

13.1. The Animal Politics Foundation will process the personal details of Customer in accordance with the privacy statement published on the Website.

Article 14. Final Provisions

14.1. This Agreement is governed by Dutch law.

14.2. To the extent that mandatory statutory provisions do not prescribe otherwise, any disputes that may arise as a result of the Agreement will be submitted to the competent Dutch court in the district where the Animal Politics Foundation has its registered office.

14.3. If a provision in this Article turns out to be null and void, it will not affect the validity of the entire General Terms and Conditions. Parties will in these circumstances replace the void provision(s) by (a) new provision(s), which reflect(s) as near as possible the intention of the original provision.

14.4. “Written” in these General Terms and Conditions also means communication by email and fax, on the condition that the sender’s identity and the integrity of the e-mail are established.
